Insurance Fraud, Medi-Cal Fraud, and Elder Abuse Cases

The Law Office of Jonathan Turner is experienced in representing professionals including medical doctors, dentists, and chiropractors as well as licensed facilities such as nursing homes and home nursing care providers accused of insurance fraud, Medi-Cal fraud, and elder abuse. Insurance fraud, Medi-Cal fraud, and elder abuse investigations may be prosecuted administratively i.e. license discipline or criminally i.e. criminal charges. Because the Law Office of Jonathan Turner, located conveniently in Sacramento, Ca, focuses on California criminal defense as well as California professional license defense and administrative law, our office is ideal for handling insurance fraud, Medi-Cal fraud and elder abuse cases.

Generally, allegations of insurance fraud in California are handled by the CA Department of Insurance’s (“DOI”) “Fraud Division” based in Sacramento, California. DOI’s Fraud Division has a team of investigators that will aggressively investigate allegations of insurance fraud by doctors, dentists, chiropractors and nursing facilities. For example, they may use undercover investigators and/or officers to pose as patients. They may also contact potential witnesses and obtain search warrants for the medical, dental or chiropractic office at issue. These search warrants allow them to seize computers, patient files, etc…

If you are a CA medical doctor, dentist, chiropractor, or nursing care facility or nursing care provider, and you learn that the CA Department of Insurance’s Fraud Division is investigating your business, contact California Insurance Fraud Defense Attorney Jonathan Turner immediately.

If the DOI determines that criminal insurance fraud has occurred, they, in conjunction with the local district attorney will obtain a warrant for the professional’s arrest and criminal charges will be brought. In addition, the DOI will likely contact the professional’s licensing agency e.g. the CA Department of Consumer Affairs, the CA Medical Board, the Dental Board of CA, the Board of Chiropractic Examiners, the CA Board of Registered Nursing, or the Department of Social Services all of which are headquartered in Sacramento, CA. Such a report will likely cause the licensing board to issue an Accusation seeking suspension or revocation of the professional license at issue.

If you receive an Accusation from your professional licensing board, contact CA Professional License Defense Attorney Jonathan Turner right away as well.

Medi-Cal fraud and elder abuse allegations and complaints are handled by the Bureau of Medi-Cal Fraud and Elder Abuse division within the CA Department of Justice which is also based in Sacramento, CA. Medical doctors and nursing facilities that are accused of insurance fraud of the elderly and/or Medi-Cal patients often are also accused of elder abuse. Thus, the same office handles both types of claims.

The CA Bureau of Medi-Cal Fraud and Elder Abuse investigates just as aggressively as the Department of Insurance as previously described. However, unlike the DOI, the Bureau of Medi-Cal Fraud and Elder Abuse typically handles its prosecutions in-house (often in Sacramento, CA) rather than having the local district attorney handle them. They too will likely notify the alleged offending doctor, dentist or nursing home or nursing care provider to their corresponding CA licensing board.

If you are a CA medical doctor, dentist or nursing care provider or nursing home, and are being investigated or even just contacted by the CA Bureau of Medi-Cal Fraud and Elder Abuse, contact CA Medi-Cal Fraud and Elder Abuse Defense Attorney Jonathan Turner right away.
