Administrative Law Sacramento California – Re-Applying for Denied Licenses
If your application for a California professional license results in a denial, you can re-apply for the denied license usually within 1 to 3 years depending on the licensing board or agency involved.
Likewise, if you had a California professional license, such as a nursing license, teaching credential, therapists license, psychology license, medical license, attorney license, brokers license, real estate license, insurance license, etc… that was revoked or surrendered, you can usually apply for reinstatement of the license after 1 to 3 years (see CA Government Code section 11522).
The longer one waits to re-apply or apply for reinstatement, the better their chances of acceptance. This is because when evaluating a CA professional licensing application for a license that was previously denied, surrendered or revoked, the focus for the Board is “rehabilitation.” Rehabilitation can mean of a number of things depending on the alleged misconduct involved. It may include alcohol or substance abuse counseling. It may include psychotherapy or counseling. If the misconduct involved included a criminal conviction, then rehabilitation may mean getting off of probation, getting the conviction expunged or set aside and dismissed (CA Penal Code section 1203.4), and/or getting a felony reduced to a misdemeanor per CA Penal Code section 17(b). This general rule regarding “rehabilitation” applies to nearly every CA licensing board and agency including the Commission on Teacher Credentialing, the Board of Registered Nursing, the Board of Vocational Nursing, the Board of Behavioral Sciences, the Department of Consumer Affairs, the Department of Social Services, the Board of Psychology, the CA Court Reporters Board, the Department of Real Estate, the Department of Insurance, the Chiropractors Board, the Medical Board, the Veterinarians Board, the Dental Board, and the Board of Real Estate Appraisers.
If you have had a CA professional license previously denied or revoked do not give up hope. You may still have a very good chance at getting your license. However, in order to enhance your chances of being successful it is crucial that you have an experienced administrative law/professional licensing attorney with you every step of the way.
